1. Who we are and what these terms cover

These Terms & Conditions ("Terms") are a legal agreement between you and Fimuro ("Fimuro", "we", "us"), a business operating in Bangladesh from Ullapara, Sirajganj, Bangladesh.

They govern your use of the website fimuro.com, the web application at fimuro.com, and every related service, feature and content we provide (together, the "Service"). By creating an account, making a payment or using the Service you accept these Terms, our Privacy Policy, Refund & Cancellation Policy, Delivery Policy and Cookie Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and able to enter a binding contract under the laws of Bangladesh to use the Service. If you use the Service on behalf of a company or organisation, you confirm that you have authority to bind it to these Terms, and "you" includes that organisation.

3. Your account

• You must give accurate, current information when you register and keep it updated.
• You are responsible for everything that happens under your account and for keeping your password confidential. Tell us immediately at [email protected] if you suspect unauthorised access.
• One person may hold one account. Agency packs allow up to five named team members on one balance.
• We may suspend or close accounts that breach these Terms, are used fraudulently, or remain inactive for 24 months with a zero balance.

4. The Service

Fimuro provides tools that generate and edit images and short videos using artificial intelligence, based on text prompts and files you upload. Outputs are produced by automated models and may be inaccurate, unexpected, or similar to outputs produced for other users from similar prompts. We do not guarantee that any output is unique, suitable for a particular purpose, or free of third-party rights.

We may change, add or remove features, models and credit costs at any time. Material changes to credit costs of an action are announced in the studio at least 7 days in advance and never reduce a balance you have already bought.

5. Credits, pricing and payment

• The Service is sold as prepaid credit packs listed on our Pricing page. Prices are shown in Bangladeshi Taka (BDT) for customers in Bangladesh and in US dollars (USD) for international customers, and include applicable taxes unless stated otherwise. The currency shown at checkout is the currency charged.
• BDT payments are collected through EPS (Easy Payment System), a payment gateway licensed by Bangladesh Bank, and may be made by bKash, Nagad, Rocket, Upay, Visa, Mastercard, AMEX or internet banking. USD payments are collected through our international card/PayPal gateway partner. By paying, you also agree to the payment provider's own terms.
• Fimuro does not store full card numbers, mobile-wallet PINs or bank credentials.
• Credit packs are one-time purchases. There is no subscription and no automatic or recurring charge.
• Credits are valid for 12 months from the date of purchase, are non-transferable, and have no cash value except as set out in the Refund & Cancellation Policy.
• A tax invoice is emailed after every successful payment and is available under Billing in your account.
• If a payment is reversed, charged back or found to be fraudulent, we may deduct the corresponding credits and suspend the account until the matter is resolved.

6. Delivery of the Service

Fimuro sells digital services only. Credits are delivered to your account balance electronically, normally within seconds of payment confirmation. Nothing physical is shipped. Full details are in our Delivery Policy.

7. Refunds and cancellation

Because credits are delivered instantly, refunds are limited. You may request a refund within 7 days of purchase if fewer than 10% of the pack's credits have been used, and at any time where a fault on our side prevented use. The full rules and the request process are in our Refund & Cancellation Policy, which forms part of these Terms.

8. Acceptable use

You agree not to use the Service to create, upload or distribute content that:

• is sexually explicit, or sexualises or depicts minors in any harmful way;
• depicts a real, identifiable person in a misleading, defamatory or intimate way without their consent (including "deepfakes");
• promotes violence, terrorism, hatred or discrimination against any group;
• infringes copyright, trademark, privacy or other rights of any person;
• is intended to defraud, spam, or deceive;
• violates the laws of Bangladesh, including the Digital Security / Cyber Security Act and the Penal Code, or the laws of the place where you use the content.

You also agree not to reverse-engineer, scrape, overload or resell the Service, or to bypass credit accounting, rate limits or safety filters. We may remove content, refuse generations and close accounts that breach this section, without refund.

9. Your content and generated output

• Your uploads remain yours. You grant us a licence to process, store and display them only as needed to provide the Service to you.
• Generated output: subject to these Terms and to the extent permitted by law, we assign to you all rights we may hold in the images and videos generated from your prompts on a paid pack, and you may use them for personal and commercial purposes. Output generated on free credits may be used for personal and commercial purposes as well, but we may display it as examples in the studio.
• You are solely responsible for how you use output and for confirming it does not infringe anyone's rights. AI-generated works may have limited or no copyright protection in some jurisdictions.
• We do not use your private uploads or private outputs to train models, and we do not sell them.

10. Our intellectual property

The Service, including the Fimuro name and logo, software, design, text and any content we create, is owned by Fimuro or its licensors and protected under the Copyright Act 2023 and Trade Marks Act 2009 of Bangladesh and international treaties. Except for the rights to output granted above, nothing in these Terms transfers any intellectual property to you.

11. Availability and support

We aim for the Service to be available 24 hours a day but do not guarantee uninterrupted access. Planned maintenance is announced in advance where possible. Support is provided by email at [email protected] and by phone/WhatsApp at +880 1790-648132 during Saturday–Thursday, 10:00–22:00 (Bangladesh Standard Time, GMT+6).

12. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including fitness for a particular purpose, non-infringement and accuracy of output. Nothing in these Terms limits rights you have under the Consumer Rights Protection Act 2009 of Bangladesh that cannot be excluded.

13. Limitation of liability

To the extent permitted by law, Fimuro's total liability to you for any claim arising from the Service in any 12-month period is limited to the amount you paid us in that period. We are not liable for indirect, incidental or consequential losses, loss of profit, data or goodwill, or for content you create with the Service.

14. Indemnity

You will indemnify Fimuro against claims, losses and costs (including reasonable legal fees) arising from your breach of these Terms, your uploads, or your use of generated output.

15. Termination

You may stop using the Service and delete your account at any time from Settings or by emailing [email protected]. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service (in which case unused credits bought within the previous 12 months will be refunded pro rata). Sections that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability and governing law, will survive.

16. Changes to these Terms

We may update these Terms from time to time. The date at the top shows the latest version. Material changes will be announced by email or in the studio at least 30 days before they take effect for existing users. Continued use after that date means you accept the updated Terms.

17. Governing law and disputes

These Terms are governed by the laws of the People's Republic of Bangladesh. Any dispute that we cannot resolve through support within 30 days will be subject to the exclusive jurisdiction of the courts of Dhaka, Bangladesh. Consumers may also raise complaints with the Directorate of National Consumer Rights Protection (DNCRP).
